While PAT testing is not explicitly named in legislation, it is the recognised method for demonstrating that portable electrical appliances have been inspected and tested as part of your duty of care. Whilst PAT (or Portable Appliance Testing) is not a direct legal requirement for landlords in the UK, they are legally obliged to ensure all supplied electrical appliances are safe. What is PAT testing and why is it important?

PAT testing, also called Portable Appliance Testing, involves an inspection of all the portable electrical appliances (those fitted with a plug) in your property to ensure they are safe to use. This procedure helps to prevent electrical accidents and ensures you are complying with your safety obligations as a landlord or property agent.

The test includes a visual inspection to assess the condition of the appliance, then where necessary electrical tests are carried out to check that each appliance is safe to continue using. In the case of a fridge freezer for example we will check for earth continuity and insulation resistance to make sure both earth and insulation protection measures are functioning correctly.

What are the legal PAT testing requirements for landlords?

UK law does state that electrical equipment must be maintained to prevent danger. PAT testing is the best way to fulfil this legal obligation because it’s a practical and relatively straightforward way to assess the safety of portable electrical devices.

Landlords have a legal responsibility to ensure that all electrical installations* and appliances in their properties are in safe working order. The Landlord and Tenant Act 1985 specifies that ‘electrical equipment provided for tenants must be deemed safe at the start of the tenancy and maintained throughout’.

One situation where a PAT test can be legally required is when it is included as a condition of a property licence. Newcastle City Council require this for HMO licensing.

The introduction of The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 further emphasises landlords’ obligations to keep electrical installations in safe working order throughout the tenancy.
